TERMS OF SERVICE

PREPAID

1. Cost for a Standard Installation is R 2 999,00. This includes a dish, mast, bracket, cable and a Wi-Fi router. All equipment will be installed at the customer’s
premises.
2. Bandwidth is billed pro rata on a prepaid basis.
3. Invoices will be generated on the 25th of every month and are due on the 1st of every month unless arrangement have been made for different payment dates.
4. We offer a 30-day “cooldown” period whereby you, the Subscriber, can cancel the month-to-month agreement and we, the Service Provider, will refund the
entire installation cost charged. Refunds will be honoured, provided, that notice was given within 30 days of the installation date.
5. Only the installation cost will be refunded and not the subscription within the “cooldown” period.
6. Once the “cooldown” period has expired the agreement will be on a month-to-month basis. If cancellation is given before the 25th of the month the subscription
will be ended on the last day of the applicable month. If notice of cancellation was given after the 25th the agreement will be terminated on the last day of the
following month.

RENTALS

1. Cost for standard installation is R 999,00.
2. Minimum contract term is 18 months.
3. An additional amount of R 150.00 will be charged with the subscription amount whereby we will insure the equipment against theft and lightning damage.
4. Bandwidth is billed pro rata on a prepaid basis.
5. Invoices will be generated on the 25th of every month and are due on the 1st of every month unless arrangement have been made for different payment dates.
6. We offer a 30-day “cooldown” period whereby you, the Subscriber, can cancel the month-to-month agreement and we, the Service Provider, will refund the
entire installation cost charged. Refunds will be honoured, provided, that notice was given within 30 days of the installation date.
7. Only the installation cost will be refunded and not the subscription within the “cooldown” period.
8. Once the “cooldown” period has expired the agreement will be on a rental basis.
9. A minimum term of 30 days will be accepted on rentals. If cancellation is received before the 25th of the month the subscription will be ended on the last day of
the following month.
10. Should the rental agreement be cancelled before the first 18 months has expired, you the Subscriber will be liable to pay the full 18 months subscription upon
termination date of your subscription. A fee of R395.00 will also be levied against you, the Subscriber for the removal of the equipment. Failure to adhere to the
cancellation terms in this Service Contract will result in the Subscriber being listed with the credit bureaux in line with Regulation 19 (4) of the National Credit Act
34 of 2005.
11. You, the Subscriber, will be granted a period of 7 days to return the equipment to us, the service provider, should we not be able to contact you to remove the
equipment.

CONTRACTS

1. Cost for standard installation is R 999.00.

3. Bandwidth is billed pro rata on a prepaid basis.
4. Invoices will be generated on the 25th of every month and are due on the 1st of every month unless arrangement have been made for different payment dates.
5. We offer a 30-day “cooldown” period whereby you, the Subscriber, can cancel the month-to-month agreement and we, the Service Provider, will refund the
entire installation cost charged. Refunds will be honoured, provided, that notice was given within 30 days of the installation date.
6. Only the installation cost will be refunded and not the subscription within the “cooldown” period.
7. Once the “cooldown” period has expired the agreement will be on a contract basis.
8. Should this agreement be cancelled before the contract term has expired a “buy out” option will be applicable.
9. Should the agreement be cancelled before the first 24 months has expired, you the Subscriber will be liable to pay the full 24 months subscription upon
termination date of your subscription. A fee of R395.00 will also be levied against you, the Subscriber for the removal of the equipment. Failure to adhere to the
cancellation terms in this Service Contract will result in the Subscriber being listed with the credit bureaux in line with Regulation 19 (4) of the National Credit Act
34 of 2005.
10. You, the Subscriber, will be granted a period of 7 days to return the equipment too us, the Service Provider, should we not be able to contact you to remove the
equipment.

UPGRADES, DOWNGRADES AND INSTALLTION

1. The subscriber can upgrade or downgrade the services or cancel this service contract any time with a minimum of 1 calendar months’ notice to Tower 3, unless
specified otherwise. The subscriber will be liable for all fees up until the last day of the calendar month notice period. Upon final termination Tower 3 shall
remove all rented and/or unpaid equipment owned by Tower 3 from the client’s premises at no later than 7 days from date of cancellation.
2. The Subscriber agrees that in the event that the subscriber is held in breach of the contract all parameters, prescribed by this agreement will be applicable to the
letter of the law. In other words, should the subscriber downgrade their line and the contract term is not successfully completed, the subscriber will be held liable
for the full amount as indicated in this agreement.
3. To request upgrades/downgrade, please ensure to log a detailed ticket with the support desk 1 month prior to requested date: support@tower3.co.za.
Installation Options – Terms and Conditions

ACCOUNTABILITY

1. The subscriber hereby consents to and authorizes Tower 3 to process its personal information, which includes but is not limited to, the name. identity or
registration number, banking details of the subscriber for the purpose of performing the services in terms of this Service Contract. The subscriber hereby consents
to and authorizes Tower 3 to conduct a credit assessment with the credit bureau on the subscriber and its/directors/members/proprietors.
2. Tower 3 reserves the right to pursue the subscriber for any outstanding debt in terms of Section 129 of the National Credit Act 34 of 2005.Tower 3 reserves the
right to list the defaulting subscriber as a defaulter with he credit bureaux in line with Regulation 19(4) of the National Credit Act 34 of 2005.
3. The subscriber understands that the subscriber’s personal information given to Tower 3 is to be used for the purposes of assessing credit worthiness and in order
to perform in terms if this Service Contract and the subscriber consents thereto.
4. Tower 3 will take the appropriate measures to ensure the personal information is kept secure and protected against unauthorized or unlawful processing. Tower
3 will not use or disclose he personal information to third parties without the subscribers consent., unless the use or disclosure is required to carry out the
performance of the Service Contract between Tower 3 and the subscriber; to comply with applicable law, order of court or legal purposes; and/ or disclosure is
necessary to protect and defend the legitimate interests of Tower 3.

GENERAL TERMS

1. Service call will be billed at the prescribed company rates. Irrespective of the installation option chosen above, service call for whatsoever reason are not included
in the subscription.
2. Point 1 of our general terms will not be valid if the customer has a service level agreement with Tower 3 Telecommunications
3. The applicant/s on this document is not permitted to use the Tower 3 name or its affiliate names in any referrals such as postings and recommendations for
whatever reason he or she may deem fit. If the applicant/s would like to earn commissions for sales the applicant/s must complete a sales partner form before
any posting may be made.
4. Tower 3 Telecommunications do not accept any responsibility for damages caused due to loss of services, all services are supplied as a best effort service.

OTHER

1. All applications / agreements will be subjected to a Credit check / verification. By signing this agreement, you, the Subscriber, consent to a Credit check (ITC /
Experian).
2. We reserve the right to make minor changes to this agreement and send updates to you, the Subscriber.
3. All communication is considered confidential, but we reserve the right to make public the Subscriber’s details should the subscription be used for any unlawful
activities.
4. All Communication as referred to in the above point 3 will include but not be limited to Whatsapp messenger, emails, twitter, Facebook and Instagram.
5. We reserve the right to pursue legal action in terms of the law should the subscriber not return any equipment that belongs to the Service Provider within 7 days
of the cancellation date.
6. Payment is strictly due on the 1st of every month unless arranged and agreed to prior with management.
